These terms apply when you buy from sleepsters.com. By placing an order you agree to them.
Nothing in these terms limits, excludes or modifies your rights under the Australian
Consumer Law. Where these terms conflict with those rights, those rights prevail.
ORDERS AND PRICING
All prices are shown in Australian dollars (AUD). Shipping is calculated at checkout once
you enter your delivery address and is shown before you pay.
We try to keep pricing and stock accurate, but errors happen. If we discover a pricing or
availability error affecting your order, we will contact you and offer you the choice of
proceeding at the corrected price or cancelling for a full refund. We will never charge you
more than the price you agreed without your consent.
Your order is accepted when we send your order confirmation email.
PRODUCT INFORMATION AND NOISE REDUCTION RATINGS
Noise reduction figures quoted on this site are manufacturer-rated and measured under
laboratory conditions. Real-world performance varies with fit, insertion depth, ear
anatomy, and the type and frequency of the noise. Our products have not been tested or
certified to AS/NZS 1270 and are not sold as industrial or occupational hearing protection.
Do not rely on them for protection in a workplace or any setting where hearing protection
is required by law or by a risk assessment.
NOT A MEDICAL DEVICE
Our products are general consumer sleep and comfort products. They are not medical devices.
They are not intended to diagnose, treat, cure or prevent any condition, including snoring,
sleep apnoea, insomnia, tinnitus or hearing loss.
If you have a diagnosed sleep or breathing condition, ear or nasal condition, ear
infection, perforated eardrum, or you are recovering from ear surgery, speak to a qualified
health professional before using ear plugs or any sleep product. Stop using a product and
seek medical advice if you experience pain, irritation, discharge, or any change in hearing.
Keep small parts away from children and pets. These products are not intended for use by
children without adult supervision.
HYGIENE AND SHARED USE
Ear plugs, ear tips and mouth products are personal items. Do not share them. Clean and
replace them as described on the packaging.
YOUR ACCOUNT AND ORDERS
You agree to give accurate delivery and contact details. We may cancel and refund an order
if we reasonably believe it is fraudulent, or if we cannot ship to the address given.
INTELLECTUAL PROPERTY
The Sleepsters name, logo, site content, text, images and design are owned by us or used
under licence. You may not copy or reuse them commercially without our written permission.
LIABILITY
To the extent permitted by law, and subject always to the Australian Consumer Law
guarantees, we are not liable for loss or damage arising from use of a product contrary to
its instructions or these terms, or from reliance on noise reduction figures beyond the
limits described above.
CHANGES TO THESE TERMS
We may update these terms. The version that applies to your order is the version published
when you placed it.
